These General Terms and Conditions of Sale, hereinafter the “Terms and Conditions”, govern sales made on showgiftprive.com.
These Terms and Conditions are entered into between:

Hereinafter the “Seller”.
And any natural person or legal entity placing an order on showgiftprive.com, hereinafter the “Customer”.
Article 1 – Purpose
These Terms and Conditions define the rights and obligations of the Seller and the Customer in connection with the online sale of products offered on showgiftprive.com.
Products offered may include, in particular, high-tech products, computer components, processors, motherboards, SSDs, consoles, electronic accessories, any digital products, digital gift cards and any other products presented on the website.
Any order placed on showgiftprive.com implies the Customer's full and unconditional acceptance of these Terms and Conditions.
Article 2 – Acceptance of the Terms and Conditions
The Customer acknowledges having read these Terms and Conditions before confirming the order.
Confirmation of the order constitutes unconditional acceptance of these Terms and Conditions.
No specific condition of the Customer may prevail over these Terms and Conditions unless previously accepted in writing by the Seller.
The applicable Terms and Conditions are those in force when the order is confirmed.
Article 3 – Products offered
The products offered for sale are those displayed on the website when consulted by the Customer, subject to availability.
The Seller makes reasonable efforts to present the essential characteristics of products clearly: product name, condition, price, availability, main specifications, delivery method or digital delivery method where the product is digital.
Photographs, visuals and illustrations are provided for information purposes. They are not absolutely contractually binding, except where the essential characteristics of the product are clearly shown.
In the event of an obvious error in a price, description, availability or essential characteristic, the Seller reserves the right to cancel the relevant order and inform the Customer.
Article 4 – Products sold as Tray versions or without retail packaging
Certain products may be sold as Tray versions, without original retail packaging or with simplified packaging.
Where this is stated on the product page, the Customer acknowledges having been informed that the product may be delivered without original retail packaging.
This presentation does not affect the Customer's statutory rights, including the statutory right of withdrawal, the legal guarantee of conformity and the guarantee against hidden defects.
However, the product must be returned complete, properly protected and with the accessories and components supplied on delivery.
Article 5 – Digital gift cards
The website may offer digital gift cards allowing the Customer to receive credit that can be used exclusively on showgiftprive.com.
Digital gift cards are sent by email after the order has been confirmed. No physical medium is shipped for digital gift cards.
The amount paid, the credit received and any bonus amount are stated on the relevant product page before the order is confirmed.
Gift cards can only be used on showgiftprive.com, subject to the products available when they are used.
Gift cards cannot be exchanged for cash, withdrawn in cash or used outside showgiftprive.com.
Where a gift card is used only in part, the remaining balance remains available for use on the website, subject to the conditions applicable to the gift card.
Any expiry period for a gift card is stated on the product page, in the delivery email or on the digital medium sent to the Customer.
If the Customer loses, deletes, voluntarily transfers or discloses a gift-card code, the Seller cannot be held responsible for use of that code by a third party, unless fault by the Seller is proven.
Article 6 – High-value gift cards
Certain gift-card packs may represent a significant value, including packs such as Seller Pack or Pro Pack.
For security, fraud-prevention, misuse-prevention or payment-verification purposes, the Seller may carry out additional checks before sending a high-value gift card.
These checks may concern, in particular, the Customer's identity, consistency of the order, the email address used, the payment method, order history or any information necessary to secure the transaction.
The Seller may request additional information or supporting documents from the Customer where necessary to verify the order.
Refusal to provide the requested information may result in suspension or cancellation of the order.
The Seller reserves the right to delay delivery, refuse or cancel any order presenting a risk of fraud, misuse, suspicious payment, identity theft or non-compliance with these Terms and Conditions.
If an order is cancelled before the gift card is issued or used, any applicable refund will be made to the payment method used for the order.
Article 7 – Specific provisions for the Pro Pack
Where the website offers a Pro Pack, the exact conditions of the pack are stated on the product page before the order is confirmed.
If the Pro Pack allows the Customer to pay a specified amount and receive a higher total credit usable on showgiftprive.com, the amount paid, total credit received and bonus amount are clearly stated on the product page.
For technical reasons, Pro Pack credit may be delivered as several separate digital gift cards.
Where the Pro Pack includes a main gift card and a free bonus gift card, the Customer acknowledges that the amount displayed at checkout is the amount actually paid and that any bonus may be sent separately after the order has been approved.
The total credit does not necessarily correspond to one single gift card, but to the combined value of the digital gift cards sent to the Customer.
The bonus gift card cannot be redeemed for cash, converted into a bank transfer or used outside showgiftprive.com.
Article 8 – Orders
The Customer places an order directly on showgiftprive.com by following the steps in the ordering process.
Before final confirmation, the Customer must check the contents of the order, total price, contact details, email address and, where applicable, delivery address.
The order is considered final once payment has been successfully authorised and an order confirmation email has been sent.
The Seller reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer, suspected fraud, declined payment, an obvious error, product unavailability or non-compliance with these Terms and Conditions.
Article 9 – Prices
Prices are stated in euros and correspond to the final prices charged to the Customer. VAT not applicable, Article 293 B of the French General Tax Code (CGI).
Delivery charges, where applicable, are displayed before the order is confirmed.
No physical delivery charge applies to digital gift cards or digital products unless otherwise stated.
The Seller reserves the right to change prices at any time.
The applicable price is the price displayed when the Customer confirms the order, except in the event of an obvious error.
Article 10 – Payment
Payment is made online using the payment methods offered on the website when the order is placed.
The order is processed only after payment has been successfully authorised.
If payment is declined, incomplete, cancelled, disputed or considered suspicious, the Seller may suspend or cancel the order.
For high-value gift cards, the Seller may request additional checks before sending the gift-card code or codes.
The Customer confirms that they are authorised to use the selected payment method.
Article 11 – Delivery of physical products
Physical products are delivered to the address provided by the Customer when placing the order.
The Customer is responsible for the accuracy of the delivery information provided. If the delivery address is incorrect, the Seller cannot be held responsible for a delay or inability to deliver.
Estimated delivery times are stated on the website, product page, Shipping Policy or at checkout.
Unless otherwise stated, estimated delivery for physical products is generally 10 to 15 days in total, including preparation and carrier transit.
For European destinations currently served, standard delivery costs €12.90 for orders under €150 and is free for orders of €150 or more, unless a specific condition is displayed at checkout.

If no specific delivery period is stated when the order is placed, delivery will take place no later than the applicable statutory deadline.
Article 12 – Delivery of digital products and gift cards
Digital products, digital codes, any licences and digital gift cards are sent by email to the address provided by the Customer when placing the order.
Unless otherwise stated on the product page, digital gift cards are sent by email after the order has been confirmed, and delivery may take up to 4 business days where checks are required.
The Seller may delay delivery of a digital product or gift card where verification of the order, payment or Customer's identity is required.
No physical parcel is sent for a digital gift card or product described as digital.
The Customer must check that their email address is correct before confirming the order.
Article 13 – Availability
Product offers remain valid while displayed on the website, subject to availability.
If a product becomes unavailable after the order has been confirmed, the Seller will inform the Customer as soon as possible.
Depending on the circumstances, the Customer may accept an equivalent product, wait for restocking, or obtain cancellation and a refund of the relevant order.
Article 14 – Statutory right of withdrawal
Under the regulations applicable to distance sales, consumer Customers have a statutory period of 14 calendar days in which to exercise their right of withdrawal without having to give a reason for their decision.
For physical products, this period begins on the day after the product is received by the Customer or by a third party designated by the Customer.
Where several items are delivered separately, the period begins on the day after the last item, batch or parcel is received.
If the last day of the period falls on a Saturday, Sunday or public holiday, the period is extended to the next working day.
To exercise the right of withdrawal, the Customer must inform the Seller of the decision by a clear statement sent to: contact@showgiftprive.com
The Customer may use the following model wording:
“I hereby give notice that I withdraw from the contract relating to the following order: [order number], ordered on [date], received on [date if applicable], Customer name: [name], email address: [email].”
Where withdrawal is valid, the Customer must return the product within a maximum of 14 calendar days after informing the Seller of the decision to withdraw.
Return shipping costs for physical products are borne by the Customer, except where the Seller made an error, the product was defective on arrival, the product was damaged on arrival or the product did not conform to the order.
Article 15 – 60-day commercial return policy
In addition to the statutory 14-day right of withdrawal, the Seller offers a commercial return period of up to 60 days after delivery of the item.
This commercial policy allows the Customer to request a return beyond the statutory period, provided that the product is eligible for return and meets the conditions set out in these Terms and Conditions and in the website's return policy.
This 60-day commercial return policy never limits the statutory right of withdrawal, the legal guarantee of conformity, the guarantee against hidden defects or any other statutory consumer right.

Article 16 – Returns of physical products
To be accepted, a returned product must be complete, clean, undamaged and in a condition that allows it to be inspected.
The product must be returned with its accessories, instructions, protective materials, cables, supplied components and original packaging where these are available.
Where the original packaging is not available, the product must be returned in equivalent packaging that provides sufficient protection against damage during transport.
The Customer may handle the product only to the extent necessary to establish its nature, characteristics and proper functioning.
If the product has been handled beyond what is necessary for this inspection, the refund may be reduced to reflect any loss in value, within the limits permitted by applicable regulations.
The absence of original packaging is not, by itself, sufficient grounds to refuse a return under the statutory right of withdrawal. However, the Customer remains responsible for ensuring that the product is properly packaged for return.
If damage is caused by insufficient packaging during the return shipment, the refund may be reduced if the product has lost value as a result.
Article 17 – Refunds
Once the return has been approved, the refund will be made to the payment method used for the order.
Under the statutory right of withdrawal, the refund will be made within a maximum of 14 days after receipt of the withdrawal request.
However, the Seller may withhold the refund until the returned product is received or until proof that it has been sent back is received.
The refund includes the initial standard delivery costs where required by law.
Additional costs resulting from a more expensive delivery method chosen by the Customer are not refunded beyond the cost of standard delivery.
For a partial return of an order, the initial delivery costs are refunded in accordance with the applicable rules. Where delivery costs are charged as a flat rate and remain justified by the items retained, they may not be refunded.
If the product has lost value because of excessive handling, improper installation, damage, scratches, impact, breakage, missing accessories or insufficient protection during return shipping, the refund may be reduced within the limits permitted by applicable regulations.
Article 18 – Excluded or restricted products
Certain products cannot be returned where provided by law, including:
- Products personalised or made to the Customer's specifications.
- Sealed products that have been opened and cannot be returned for hygiene or health-protection reasons.
- Software, digital licences, activation codes, digital content or digital services that have already been supplied, activated, downloaded, used or consumed with the Customer's prior agreement where permitted by law.
- Products that are incomplete, substituted, fraudulently returned or returned in a condition that prevents their identification or inspection.
- Products damaged by misuse, incorrect installation, breakage, oxidation, modification, deliberate damage or use that does not comply with their intended purpose.
These exclusions do not limit the Customer's statutory rights where a product is defective, non-conforming or damaged on arrival.
Article 19 – Withdrawal applicable to digital gift cards
For digital gift cards, consumer Customers retain their right of withdrawal under the applicable statutory conditions while the gift card has not been used.
Where a gift card has been used in whole or in part, a refund may be refused or limited to the unused value, depending on the circumstances and in accordance with applicable regulations.
If withdrawal is accepted for an unused digital gift card, the relevant gift-card code may be deactivated before the refund is issued.
For packs including a free bonus, such as the Pro Pack, withdrawal also results in deactivation of the bonus gift card if it has not been used.
If the bonus gift card has already been used, its value may be deducted from any refund, within the limits permitted by applicable regulations.
Article 20 – Digital products, licences and activation codes
Where the website offers a digital product, licence, activation code or digital subscription, the product-specific conditions are stated on the product page.
Before ordering, the Customer must check that the digital product is compatible with their device, operating system, country of use and requirements.
Unless otherwise stated, digital codes are sent by email after the order has been confirmed.
No physical medium is sent for a product described as digital, a licence or an activation code.
The Seller cannot be held responsible for incompatibility resulting from the Customer's failure to carry out the necessary checks before ordering, except where there is an obvious error on the product page.
Article 21 – Defective, damaged or non-conforming products
If the Customer receives a product that is defective, damaged or does not conform to the order, the Customer should contact the Seller promptly so that the request can be handled efficiently:
The Customer should include the order number, a description of the problem and, where possible, photographs of the product, packaging and shipping label.
The Seller will tell the Customer how to proceed.
Where the defect, damage or non-conformity is confirmed, return shipping costs are not borne by the Customer.
This procedure does not limit the Customer's statutory rights under the legal guarantee of conformity or the guarantee against hidden defects.
Article 22 – Legal guarantee of conformity
Consumer Customers benefit from the legal guarantee of conformity applicable to goods purchased from a professional seller.
This statutory guarantee applies independently of the 60-day commercial return policy and any other commercial warranty offered on the website.
The Seller is required to deliver goods that conform to the contract and is liable for lack of conformity existing when the goods are delivered.
The legal guarantee of conformity allows the Customer, in particular, to request that the product be brought into conformity where it does not conform to the contract.
In the circumstances provided by law, the Customer may request repair, replacement, a price reduction or termination of the sale.
The legal guarantee of conformity is free of charge for the consumer.
For new and second-hand goods, the applicable statutory period is 2 years from delivery of the goods.
This guarantee never limits the Customer's other statutory rights.
Article 23 – Guarantee against hidden defects
The Customer may also benefit from the statutory guarantee against hidden defects where the conditions provided by law are met.
This guarantee may apply where a hidden defect makes the product unfit for its intended use or reduces that use so substantially that the Customer would not have purchased it, or would have paid a lower price, had they known of the defect.
This guarantee applies independently of these Terms and Conditions, the legal guarantee of conformity and the 60-day commercial return policy.
Article 24 – Liability
The Seller cannot be held liable for indirect damage resulting from use of the website or purchase of a product, except where otherwise required by law.
The Seller cannot be held liable for a delay or failure to perform resulting from force majeure, an unforeseeable and unavoidable act of a third party, or an error attributable to the Customer.
The Seller cannot be held liable for misuse of a product, digital code or gift card by the Customer or by a third party to whom the Customer has voluntarily disclosed the code.
The limitations of liability set out in these Terms and Conditions do not apply where the law imposes mandatory liability on the Seller.
Article 25 – Personal data
Personal data collected when an order is placed is necessary to process the order, issue invoices, arrange delivery, deliver digital products, manage the customer relationship, secure transactions, handle returns and refunds, and comply with the Seller's legal obligations.
As part of fraud-prevention checks and the security measures applicable to high-value gift cards, the Seller may process additional information strictly necessary to verify the order.
The Customer has rights relating to personal data, including rights of access, rectification, objection, erasure, restriction of processing and portability, under the conditions provided by applicable regulations.

Article 26 – Intellectual property
All elements available on showgiftprive.com, including text, visuals, logos, images, product pages, graphic elements, structure and content, are protected by intellectual property law.
Any reproduction, representation, modification, adaptation or total or partial use of these elements without the Seller's prior written authorisation is prohibited.
Article 27 – Customer reviews
Any reviews published on the website must relate to a genuine experience and must not contain insulting, defamatory, fraudulent or irrelevant statements.
The Seller reserves the right to moderate or remove any review that is clearly abusive, unlawful, misleading or contrary to these Terms and Conditions.

Article 29 – Consumer mediation
In accordance with the provisions of the French Consumer Code, consumer Customers may use a consumer mediator free of charge with a view to resolving a dispute with the Seller amicably, after first submitting a written complaint to the Seller.
Referral to the mediator is possible only after a prior attempt to resolve the matter amicably directly with the Seller.

The Customer may refer a matter to the mediator under the conditions stated on the mediator's website after first submitting a written complaint to the Seller.
Article 30 – Force majeure
The Seller cannot be held liable for any delay or failure to perform its obligations in the event of force majeure within the meaning of French law.
Force majeure includes unforeseeable, unavoidable and external events preventing normal performance of the order.
Article 31 – Changes to the Terms and Conditions
The Seller reserves the right to amend these Terms and Conditions at any time.
The applicable Terms and Conditions are those in force when the Customer confirms the order.
Changes do not apply retroactively to orders that have already been confirmed, unless otherwise agreed or required by law.
Article 32 – Severability
If any provision of these Terms and Conditions is declared void, unenforceable or contrary to a mandatory legal provision, the remaining provisions will remain fully effective.
Article 33 – Governing law and disputes
These Terms and Conditions are governed by French law.
In the event of a dispute, the Customer is invited to contact the Seller in order to seek an amicable solution.
If no amicable solution is reached, the dispute will be brought before the competent courts in accordance with ordinary rules of jurisdiction.
For consumer Customers residing in the European Union, any mandatory protective provisions of the consumer's country of residence remain applicable where required by law.
By placing an order on showgiftprive.com, the Customer acknowledges having read these General Terms and Conditions of Sale and accepting them without reservation.
